Welcome to Halcy the smart way to understand what’s really inside your everyday products and how they affect you.
Halcy helps you make more informed choices about food, skincare, supplements, and personal care items using personal AI-powered analysis.

By downloading, accessing, or using Halcy (the “App”), you agree to these Terms of Service (“Terms”).
Please read them carefully before using the App.

1. About Halcy

Halcy is a mobile application that analyzes ingredient lists and product information to provide informational health insights based on publicly available data and scientific sources based on your health preferences user sets.
Our AI system helps users understand potential product impacts on health, but it does not replace medical or professional advice.

2. Eligibility & Account

To use Halcy, you must:

• Be at least 16 years old (or the minimum age of digital consent in your country).

• Create an account using a valid email address, Apple, or Google login.

• Provide accurate information during onboarding and keep your profile up to date.
  
  
  

You are responsible for maintaining the confidentiality of your account and password.
Halcy is for personal, non-commercial use only.

"By using Halcy, you represent that you are at least 16 years old 

and have the legal capacity to enter into this agreement.

3. Health Disclaimer

Halcy’s product analyses and recommendations are for informational purposes only.
We are not medical professionals and do not provide diagnosis, treatment, or medical advice.

You should always consult your physician or qualified healthcare provider before making decisions related to your health or diet.
Use of the App does not create a doctor-patient relationship.

AI-generated analyses are based on available data and may contain errors or omissions. 

Halcy does not guarantee the accuracy, completeness, or timeliness of AI-generated insights.

4. How Halcy Works

When you scan a product, Halcy’s AI analyzes its ingredients and compares them against scientific data (e.g., studies from EFSA, ANSES, IARC, and similar bodies).
Your personal health profile (e.g., sensitivities, dietary preferences, and wellness priorities) may adjust how results are displayed.

While we strive for accuracy, some data may come from third-party databases (like Open Food Facts) or public sources and may not always be complete or current.

Product information comes from third-party sources (Open Food Facts, etc.) 

and may be incomplete, outdated, or inaccurate. 

Halcy is not responsible for third-party data quality.

5. Subscriptions & Payments

Halcy offers free limited use and optional premium subscriptions (“Halcy Premium”) that unlock additional features.

Billing:
Payments are processed securely through Apple App Store or Google Play billing systems.
You will be charged the displayed rate (monthly or annual) and can cancel anytime through your app store settings.

Renewals & Cancellations:
Subscriptions renew automatically unless canceled at least 24 hours before the renewal date. You can manage or cancel your plan in your app store account settings.

Refunds:
Refunds are handled by the app stores per their respective policies.

6. Data Privacy

Your privacy matters to us.
We collect and process data in accordance with our Privacy Policy, including:

• Account data (email, preferences, profile info)

• Scanned product data

• Usage analytics (via Mixpanel and Supabase)

• AI analysis requests (via Deepseek or similar providers)

We do not sell personal data.
You can request data deletion, correction, or export at any time via the in-app settings.

7. Intellectual Property

All intellectual property rights in the Halcy App, brand, and related content (logos, text, design, AI logic) belong to Halcy.
You may not copy, reproduce, or modify the App or its components without written permission.

Any user-generated content (like product names or feedback) may be used anonymously to improve our algorithms and features.

8. Acceptable Use

You agree not to misuse Halcy by:

• Attempting to hack, reverse-engineer, or overload the system

• Uploading harmful content or malicious files

• Sharing unauthorized product data or copyrighted materials

• Using the App for medical or diagnostic purposes
  
  
  

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Liability & Warranties

Halcy is provided “as is” and “as available.”
We make no guarantees that all analyses are error-free, complete, or scientifically exhaustive.

To the maximum extent permitted by law, Halcy and its affiliates are not liable for any direct or indirect damages arising from the use or inability to use the App.

We are not liable for delays or failures due to circumstances beyond our control, 

including internet outages, third-party service disruptions, or natural disasters.

10. Termination

You may delete your account at any time via the app.
We may suspend or terminate access if you violate these Terms or misuse the App.

Upon termination, certain provisions (like limitations of liability and intellectual property rights) will remain in effect.

11. Modifications

We may update these Terms occasionally to reflect improvements or legal changes.
If changes are significant, we’ll notify you via the App or email.
Continued use after updates means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of Germany (EU), with jurisdiction in Frankfurt am Main.

If you live outside the EU, your local consumer rights remain protected.

For EU users: You may use the European Commission's Online Dispute Resolution platform. 

For other users: Disputes will be resolved through binding arbitration.

Halcy is available globally, but some features may be limited based on your location or local regulations.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

We'll notify you of significant changes via in-app notification or email at least 30 days before they take effect.
